Legislative Update

Indiana House Bill 1310
Allows a certified registered nurseanesthetist to administer anesthesia
under the direction of and in the immediate presence of a podiatrist if the
administration takes place in a hospital and a licensed physician is available
to respond immediately in person to a medical emergency.


Massachusetts SD 311
Removes the restrictions on the licenses of nurse practitioners and certified
registered nurse anesthetists as recommended by the Institute of Medicine
and the Federal Trade Commission.


Mississippi Senate Bill 2096
This bill removes the requirement that advanced practice registered nurses
must practice with a collaborative or consultative agreement with a
physician or dentist.

 

Mississippi Senate Bill 2101
This bill provides that certified nurse practitioners with over 3,600 hours of clinical practice shall not be required to have a written collaborative agreement with a physician or be required to submit patient charts to a physician for review.

 

Nebraska Legislative Bill 129
Requires criminal background checks for applicants for an initial nursing license.

 

Oregon Senate Bills 282, 283, 284, and 285
Establishes the titles Nurse, Advanced Practice Nurse, Certified Nursing Assistant and Medication Aid.

Virginia House Bill 1695
Prohibits health regulatory boards from revoking, suspending, restricting, or refusing to issue or renew a registration, certificate, license, or multistate licensure privilege or otherwise discipline a health care practitioner, including a holder of a multistate licensure privileged to practice nursing, solely on the grounds that the practitioner has mental illness.

 

Virginia Senate Bill 1018 and 1294     
Establishes state and federal criminal history background checkrequirements for applicants for licensure as a practical nurse or registered nurse beginning January 1, 2016.

 

West Virginia Senate Bill 21
Expands prescriptive authority of advanced nurse practitioners and certified nurse-midwives.

 

 

 

We saw a number of bills related to Scope of Practice.

Arkansas Senate Bill 78
Eliminates physician supervision requirements in anesthesia administration by Certified Registered Nurse Anesthetists.

Connecticut House Bill 6289
Allows APNs to sign various state-required health forms.

Florida House Bill 335
Requires psychiatric nurses to hold national advanced practice certification as psychiatric-mental health advanced practice nurse and authorizes such nurses to approve release of individuals from receiving facility after involuntary examination.

Massachusetts HD 2782
Removes the restrictions on the licenses of nurse practitionersand certified registered nurseanesthetists as recommended by the Institute of Medicine and the Federal Trade Commission.

Mississippi House Bill 893
Removes the requirement that a APRN be in a collaborative agreement with a physician or dentist.

Missouri House Bill 633
Clarifies responsibilities between physician and APRN in a collaborative agreement.

 



We saw two bills directly related to prescriptive authority.

Arizona House Bill 1136
Extends APRN prescriptive authority to include hydrocodone combination products reclassified to Schedule II if expressly authorized by the collaborative practice agreement.

Kansas Senate Bill 69
Establishes scope of practice and prescribing authority for Advanced Practice Nurses.

 

There were two bills related to discipline.  

Pennsylvania House Bill 117
Requires permanent license revocation for violations of "The Controlled Substance, Drug, Device and Cosmetic Act"

Oklahoma House Bill 1074
Prohibits licensing boards from imposing discipline against a health care provider's license, based solely on the health care provider's recommendations to an eligible patient regarding access to or treatment with an investigational drug, biological product or device, as long as the recommendations are consistent with medical standards of care.

 
There were two bills filed that adopt the Nurse Licensure Compact.

Massachusetts HD 3216
Relates to nurse licensure compact in Massachusetts

Minnesota House Bill 220
Adopts the Nurse Licensure Compact

 
There were a number of bills that made changes to the Boards of Nursing makeup or duties.

Arizona House Bill 2453
Grants the Board of Nursing the authority to adopt rules to decide scope of practice relating to abortion.

Mississippi Senate Bill 2482
Reconfigures the membership of the Board of Medical Licensure to allow the Board of Nursing to appoint a certified nurse practitioner with at least 3500 hours of clinical practice and a nurse with at least 3500 hours of clinical practice.

New Hampshire House Bill 484
Requires one member of the Board of Nursing to be active in the field of Medicaid home and community based care for the elderly or adults with disabilities.

Oklahoma House Bill 1081
Defines the duties of the Executive Director of the Board of Nursing.

Oregon Senate Bill 339
Creates a task force on school nursing, one member which will represent the Board of Nursing.

Arizona House Bill 2238
States that licensed health professionals cannot be required to participate in a third-party reimbursement program as a condition of licensure.

Connecticut House Bill 5902
Grandfathers LPNS who were practicing in 2014 from the requirements concerning medical spas

Connecticut Senate Bill 246
Defines Practice of Telemedicine to include, among other things, that the provider be licensed to practice medicine in Connecticut

New York Senate Bill 2048
Establishes the certification process for certified registered nurse anesthetists.

New York Senate Bill 2145
Requires registered professional nurses to attain a baccalaureate degree in nursing within ten years of their initial licensure. Provides exemptions for current licensees.

Oregon Senate Bill 230
Requires health care workers to submit demographic, education and other information to the Board upon license renewal
